These Terms govern access to and use of the Fanduit API, MCP server, dashboard, and related services (the "Service"), operated by DarkRhino, a sole trader based in England and Wales ("Fanduit", "we"). By creating an account or using the Service you ("Customer") agree to these Terms. If you use the Service on behalf of an organization, you represent you are authorized to bind it.
Fanduit is developer infrastructure that provides programmatic access to third-party creator platforms ("Platforms", e.g. OnlyFans, Fansly) for accounts the Customer owns or is authorized to operate. Fanduit is not affiliated with, sponsored by, or endorsed by any Platform, and is not a payment processor, content host, or agent of any Platform.
For every Platform account the Customer connects to the Service, Customer represents and warrants, on a continuing basis, that: (a) Customer is the account owner or has the account owner's express, current authorization to access and operate it via automated means; (b) the account owner is an adult and is verified as such on the Platform; (c) Customer's use complies with all applicable law; and (d) Customer has obtained all consents required to process the personal data of the account's subscribers/fans exposed through the Service.
Fanduit may require evidence of authorization and may suspend any connection it reasonably believes is unauthorized.
Customer understands that Platforms do not offer official APIs and that their own terms may prohibit automated access. Customer is solely responsible for its use of the Service in relation to any Platform's terms. Automated access carries an inherent risk of account rate-limiting, suspension, or permanent ban. Fanduit does not warrant uninterrupted access and is not liable for any Platform action against a Customer's account, including suspension, ban, data loss, or lost revenue. The Service is provided "as is" and "as available".
Customer will comply with the Acceptable Use Policy, which is incorporated by reference. Prohibited uses include non-consensual intimate imagery (NCII), any child sexual abuse material (CSAM), accessing accounts without authorization, and using the Service to harass or defraud.
Access is metered by (a) requests-per-minute limits and (b) consumable credits, per the Customer's plan. Fees are billed in advance and are non-refundable except as required by law. We may change pricing on notice. Unpaid accounts may be suspended. Billing is for developer infrastructure (API access, usage credits, seats) and is separate from any Platform transaction.
Where the Service processes personal data of the Customer's fans/subscribers, Fanduit acts as processor and Customer as controller, under the Data Processing Addendum.
Customer authorizes Fanduit to store and use Platform session credentials solely to provide the Service. Fanduit encrypts credentials at rest and restricts access, but Customer acknowledges no system is perfectly secure and connects accounts at its own risk (subject to Fanduit's security obligations in the DPA).
Customer will defend, indemnify, and hold harmless Fanduit and its officers, employees, and agents from any claim, loss, liability, damage, fine, or expense (including reasonable legal fees) arising out of or relating to: (a) Customer's use of the Service; (b) any connected account or Customer's lack of authorization over it; (c) Customer's breach of these Terms or the AUP; (d) any Platform's action or claim relating to Customer's use; or (e) Customer's handling of fan/subscriber personal data.
To the maximum extent permitted by law, Fanduit's aggregate liability is limited to the fees paid by Customer in the three months preceding the claim. Fanduit is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
Either party may terminate for convenience on notice. Fanduit may suspend or terminate immediately for AUP breach, non-payment, legal risk, or suspected unauthorized access. On termination, connected credentials are deleted.
We may update these Terms on notice. These Terms are governed by the laws of England and Wales. Questions: legal@fanduit.co.
